Description of Practice

Resolution of litigated disputes arising from employment (wrongful termination, grievances, harassment, wage and hour); agreements for goods, services, real estate or property; insurance; product liability (including toxics); professional liability (legal, medical and insurance brokers); construction and industrial accident cases.
Professional Background
Practicing exclusively as a neutral since 1999. Before this transition, litigated for more than 30 years in the areas of employment, construction, product liability, professional liability, personal injury accident cases. Lecturer and author on subjects of product liability, professional liability, construction, employment, workplace safety, settlement techniques, case evaluation and mediation. In 1985 became a member of the bench-bar committee developing the alternative dispute resolution program for the Superior Court of Sacramento. Thereafter, served as an arbitrator, settlement officer and mediator.
Experience
Served as a neutral in 800 matters involving goods, services or property; employment; personal injury accidents; product liability; insurance coverage and professional liability. Also serves as a panel member for Kaiser/Permanente, California Department of Insurance, Court of Appeals, Orange County Superior Court, San Diego Superior Court, San Diego County Bar Fee Mediation/Arbitration, Los Angeles Superior Court Mediator panel (until June 2013), and The Mediator Registry. In addition have had over 200 hours of training at Straus Institute (Pepperdine University), Loyola Law School, Court of Appeal Second District and National Conflict Resolution Center, among others.

Approach
My approach is an amalgam of evaluative and facilitative methodology, which are strategically employed as the process evolves. Tailoring the mediation process to the unique aspects of each case and the individual parties enhances the prospects for a successful integrated resolution.
Fees
Per diem rate: $375 per hour (50% payable at time of scheduling; balance prior to commencement). Travel time: 2/3 per diem rate. Mediation: 4 hour minimum. Arbitration: Four hour minimum.
