Description of Practice

25 Years of ADR Experience. Since the early 1990s, Christopher Ernst has been actively engaged in Alternative Dispute Resolution. Now, as a neutral trained by the American Arbitration Association, the Supreme Court of Ohio and Financial Industry Regulatory Authority (FINRA), Christopher brings Ohio ADR to you. An attorney with almost 30 years of experience, Christopher has litigated a wide variety of cases, from plaintiff’s personal injury to insurance defense, from business contracts to business torts, and from employment to construction, and has served as lead trial counsel in cases as large as $160 million in value. He has served as Special Master in a case valued at $450 million. He has the experience to help you resolve your case. In addition to being recognized by Best Lawyers in America, Ohio Super Lawyers and Martindale Hubbell (AV Rating – 5.0 out of 5.0), Christopher is on the approved mediator list for the United States District Court in both the Northern District of Ohio and the Southern District of Ohio. He also serves as an arbitrator and business mediator for the Cuyahoga County Court of Common Pleas. Christopher is on AAA Mediation list of mediators and is a FINRA arbitrator. As a neutral, Christopher provides services as a mediator, arbitrator and Special Master throughout the state of Ohio. He also provides Early Neutral Evaluation (ENE), mock trial and mini trial services. His primary focus is on business, tort and employment matters. He does not charge for travel time in the state of Ohio.

Experience

As a neutral, Christopher began mediating cases in 2014. The vast majority of these cases have been business contract disputes in a wide range of industries, tort cases (personal injury, medical malpractice and the like), and employment law cases. Christopher has been trained by the American Arbitration Association, Ohio Supreme Court, FINRA, and the American Bar Association. He is a member of the Dispute Resolution Section of the American Bar Association, as well as serving on the Alternative Dispute Resolution Committee of the ABA’s Litigation Section. He is a member of the Alternative Dispute Resolution section of the Cleveland Metropolitan Bar Association. He was chairperson of the Alternative Dispute Resolution practice group at his prior law firm, a leading Midwest law firm with offices throughout Ohio and clients across the country.

Approach

The role of the mediator is to create a meaningful, productive and positive dialogue so that progress toward a resolution is constantly being made. This involves learning about not just the dispute itself, but the background of parties, the nature of their relationship, and looking forward to explore what is possible. This is done through a facilitative approach and helps to crystalize the issues (both on the surface and below the surface). At times, though, it is necessary (and preferable) to become more evaluative to assist the parties in reaching their goal of resolution. Mediation should encourage the parties to realistically assess the risks of litigation/arbitration and pinpoint their interests, allowing them to rethink their positions and put aside antagonisms that impede settlement.

Fees

$325/hour. No charge for travel time within the state of Ohio.

Christopher is the author of Baldwin’s Ohio Practice: Tort Law. Published by West (a Thomson/Reuters company) and also available on Westlaw, it is the only treatise on Ohio tort law in existence. The first edition was published in 2005 and the second edition was published in 2010. It consists of 78 chapters and over 6,000 pages thoroughly analyzing tort law topics.
