As a mediator, I use a facilitative style and approach, with pointed questions to determine each party's true interests, concerns, objectives, and the validity and reasonableness (or not) of their assumptions, motivations, and expectations. I NEVER tell them how I believe the judge or jury is likely to rule; rather, I ask them if they need the judge or jury to conclude X (as to one or more key disputed facts or legal issues); do they understand that judges and juries are not infallible; and what do they believe is the percentage likelihood that the judge or jury will reach the conclusion they desire on each of those key factual issues and legal issues? I then apply those percentages to the amount they think is the maximum amount they are likely to recover if successful at trial; and they usually see the risk more clearly.


I currently charge $300 per hour as mediator, arbitrator, special master, and consultant to other attorneys.
