Research indicates that mediation is successful in more than one-half of the cases and that parties with mediated outcomes are less likely to have post-agreement disputes. With the enactment of Title 17 of the Maryland Rules relating to Alternative Dispute Resolution (ADR), there are even more opportunities for mediated resolution of the complex financial aspects arising out of a divorce. Mediation allows both parties to become educated about the realities of litigation in an informal process, without the harsh reality of a court order. The rules of evidence do not apply and witnesses are not called. Mediation may take one or several sessions. The goal remains mutually agreeable resolution and the mediator’s suggestions may provide substantial guidance. Subject to certain delineated exceptions, mediation is confidential, and “...a mediator and any person present or otherwise participating in the mediation at the request of the mediator shall maintain the confidentiality of all mediation communications and may not disclose or be compelled to disclose mediation communications in any judicial, administrative, or other proceeding.“
