Description of Practice

Lee Jay Berman began as a full-time mediator and trainer 20 years ago, and has successfully mediated over 1,800 matters. He is a national panelist with the American Arbitration Association, a Distinguished Fellow with the International Academy of Mediators, a Charter Diplomat with the National Academy of Distinguished Neutrals, internationally certified by the International Mediation Institute, and a Dispute Resolution Expert with the United Nations Development Programme. He was Mediator of the Year for the US Bankruptcy Court in 2007, California's Daily Journal named him to California’s Top Neutrals in 2008 and 2009, and he was named to the Who's Who in International Commercial Mediation in 2012 and 2013.

Also a respected trainer in the field, he founded the American Institute of Mediation, leaving his position as Director of Pepperdine Law School's "Mediating the Litigated Case" program after seven years. In addition to teaching regularly at several universities and law schools, he has trained judges, attorneys and business leaders in Croatia, India, Australia, Jordan, The Netherlands and the United Arab Emirates.

Mr. Berman launched the Santa Barbara Superior Court's successful ADR program and chaired the statewide committee that published the Standards of Practice for California Mediators. He served three years on the California State Bar's ADR Committee and has published numerous articles on mediation and ADR. He lives with his wife in Marina del Rey, California.

Successfully mediated over 1,800 civil mediations, before, during and after litigation.

•Specializing in complex, multi-party litigation including business litigation, construction defect, products liability, medical malpractice and wrongful death.

•Several hundred business/commercial cases involving breach of contract, business/corporate matters, shareholder disputes and corporate dissolutions, trade secrets, unfair competition, bankruptcy, fraud, collections, and franchise and partnership disputes and dissolutions (including several law firms).

•Several hundred construction, real property and land use cases including construction claims, defects and closeouts, land use, CEQA, environmental protection, earth movement, homeowner associations, disclosure, exchanges, brokerage and fiduciary relationships.

•Several hundred personal injury, medical malpractice and premises liability mediations.

•Over 100 employment cases including discrimination, workplace harassment, wrongful termination, whistle-blowers, and wage and hour claims.

•Over 100 entertainment, new media, intellectual property and technology cases, including cases involving film, television, music, computer games and software development.

•Several hundred other general civil cases, including insurance coverage, intellectual property, health care, legal and medical malpractice, elder abuse, probate and trusts.

Approach

After 18 years and some 1,700 mediations, it is clear to me that really good mediators can't have just one style because every dispute has different dynamics, each one calls for different tools from the mediator. Some cases require the mediator to be a stern, experienced neutral, analyzing parties' legal theories and evaluating their economic options. Other cases require me to hear underlying issues and to manage participants' emotions. Many days, I have to do both. A masterful mediator must be fully proficient in all aspects of mediation and must have undying patience, optimism and energy to see every case through to completion. Knowing what is needed and the ability to provide all of it is what I bring to the table.

Fees

$6,500 for an "All Inslusive Day" Mr. Berman’s “All-Inclusive” service for the mediation includes one pre-mediation conference call with counsel, all study time including reading briefs, travel time, reasonable expenses, and the full day mediation session until midnight, if necessary (after which additional fees will apply). $4,000 for an "All Inclusive Half-Day" Mr. Berman’s “All-Inclusive” service for the mediation includes one pre-mediation conference call with counsel, all study time including reading briefs, travel time, reasonable expenses, and the mediation session of up to 5 hours, starting or ending at 1:00 p.m. $550 per hour for extra time. Lunch, snacks, freshly ground gourmet coffee is included.
