Description of Practice

Ms. Lindoerfer is an attorney with a practice entirely as a neutral, with a focus on labor and employment matters. She was a Management Labor and Employment Attorney and a Human Resources Director for thirty years before her current practice as a mediator and arbitrator. She has extensive experience with the full spectrum of labor and employment law, and has mediated wage and hour, discrimination and harassment, wrongful termination and disability law cases. Her approach to mediation ranges from evaluative to facilitative to transformative, depending on the parties' needs. She has a warm and engaging personality that helps parties and their counsel to become comfortable with the mediation process and with her.

Professional Background

Ms. Lindoerfer was admitted to the California Bar in 1977. She worked as a Labor and Employment Lawyer in several settings, all in or related to public education, at all levels from K-12 districts to the university level. She also served as a Human Resources Director or employee relations professional at those same levels of education. Her experience included 13 years at the community college level, with the full range of responsiblity for labor and employee relations and human resources management. She has served as Section 504 Coordinator, and has broad experience with issues related to students with disabilities at all levels of education. This experience has been most helpful in her work as a mediator and arbitrator, in allowing her to understand the employee and the human resources' perspective and the student's perspective in disputes.

Experience

Ms. Lindoerfer served on the Los Angeles County Superior Court Alternative Dispute Resolution Party Pay and Pro Bono Panels since 2004. She has mediated approximately 100 cases, both through the LASC and as a private mediator. She also serves on the USDC (Central District) Panel of Mediators. She has mediated Special Education federal cases. In addition, she serves as a Police Community Mediator for the Pasadena Police Department through the Western Justice Center. She also volunteers at the Western Justice Center in their mediation training for K-12 students, teachers, and in their workplace conflict resolution programs. As a Human Resources professional, she was called upon to mediate numerous disputes among employees. As a Section 504 Coordinator, she assisted students with disabilities in disputes regarding their educational programs.

Degrees

Ms. Lindoerfer has a Juris Doctor Degree from UCLA School of Law. She has had extensive mediation training, including the Pepperdine School of Law Straus Institute's "Mediating the Litigated Case;" the Harvard Negotiation Insight Initiative's "Master Class for Mediators;" Los Angeles County Bar Association Dispute Resolution Services basic and advanced courses; and numerous continuing education programs in mediation and arbitration.

Approach

Ms. Lindoerfer is stongly committed to the parties' self determination in the mediation process. This results in her primary approach to mediation being facilitative rather than evaluative. If the parties both wish her to take an evaluative approach, she is both capable and willing to do so, given her broad knowledge of employment and labor law, and the laws protecting employees and students with disabilities . If there is going to be an ongoing relationship between the parties after the mediation, Ms. Lindoerfer is both capable and willing to use a transformative approach to make it possible for the parties to work together productively in the future. Ms. Lindoerfer is committed to equal rights in the workplace and in education. She has served on both the Women's and Accessibility and Disability Commissions in the City of Pasadena, where she resides. She believes strongly that both employers and employees with disabilities benefit if they are able to agree to a reasonable accommodation for an employee with a disability that permits him/her to continue to work. She also believes that all of us benefit when students with disabilities receive a free, appropriate education.

Fees

For other than Los Angeles County Superior Court ADR Panel cases, $275/hour to be shared by the parties or as agreed for mediations. Cancellation fees for mediations: $500 if cancelled prior to 14 days of the scheduled mediation or arbitration; one-half of a full day's fees if cancelled after the fourteen days, but prior to the scheduled date; if cancelled on the scheduled date, a full day fee.

Other Information

Although Ms. Lindoerfer is not fluent enough in Spanish to conduct a mediation in that language, she has enough ability to be able to make parties whose primary language is Spanish comfortable with the process and with her as the mediator. Of course, appropriate interpreter services must always be provided in addition to this effort on Ms. Lindoerfer's part. Ms. Lindoerfer is also a member of the panel for the California Department of Insurance Residential Property, Earthquake Claims and Automobile Physical Damage Mediation Program, and is a member of the Panel of Mediators for the USDC, Central District. She also serves as an Arbitrator, FactFinder, and a Hearing Officer.
