Rachel Gupta

Helping parties bridge the gap to find common ground and resolve conflict outside the courtroom through mediation and arbitration. Mediator for complex commercial litigation, general commercial or business disputes, employment, insurance, and real estate. Arbitrator for general commercial, civil, employment and financial services issues.

Rachel Gupta is an experienced litigation attorney who has represented companies and individuals in connection with commercial and financial litigation relating to a vast number of subject matters. Her years of experience as both outside counsel and then in-house counsel, advocating for both plaintiffs and defendants, gives her a unique perspective of the law, as well as the corporate goals and processes that often motivate and sometimes prolong litigation.

Prior to founding Gupta Dispute Resolutions LLC, Rachel spent the last decade as in-house counsel representing companies in the financial industry in connection with bet-the-company litigation relating to residential mortgage-backed securities (“RMBS”), insurance, bankruptcy, derivative and securities class-actions, and employment disputes. She now brings this vast legal experience to help companies and individuals find alternative solutions to litigation through mediation, negotiation and arbitration.

Rachel’s mediation approach is facilitative, but if necessary and requested by the parties, evaluative. By fostering open communication, the exchange of information and encouraging open minds, Rachel helps the parties identify their goals, understand legal risk and ultimately move away from their positions and towards developing practical solutions that meet their needs. Through her candor, extensive preparation and utilizing her analytical skills, Rachel facilitates the party-driven negotiations to help them find the missing piece of the puzzle preventing them from reaching a negotiated outcome.
