Over twenty-five years, as a teacher and administrator, as an attorney, as a labor leader and a business owner.

ADR Experience

As an attorney, negotiated hundreds of leases and contracts as well as resolved disputes involving those documents. As President of a medium size Teachers Union negotiated several contracts and resolved hundreds of grievances. As a teacher and administrator resolved several special education issues. As a business owner, negotiated contracts and resolved consumer complaints.

Approach

My practice begins with a brief interview with each party. During this time, we will determine if this case is suitable for me to mediate. Each party must feel comfortable with me as an unbiased and impartial mediator in order for the mediation to proceed with confidence that what is shared is privileged and can not be used outside the mediation process. The principle of confidentiality promotes open and honest sharing which leads to effective communication. Effective communication drives the mediation process.

So, I focus on a simple acronym, W.H.O., to help the parties bypass emotional obstacles during mediation.
First, each party should be Willing to allow the mediator to guide the process toward resolution – that’s the W.
Second, each party should be Honest with the mediator during the process even if one must ask to share some details in private – that’s the H.
Third, each party should be Open to the possibility of finding a resolution to some or all of the issues presented – that’s the O.

Mediation is a process which works best when parties participate willingly, share honestly and remain open to the possibility of finding an agreeable resolution to the dispute. Mediation offers no guarantees but if a resolution is possible, the W.H.O. is the best path to get to it.
