Rather remarkably, Mediation.com, a company with numerous complaints against it, has been systematically displaying confidential mediation communications, seemingly as part of its misguided effort to convince other mediators to join.

Assuming that this company would eventually be forced to realize that this was a gross breach of mediation client confidentiality, here is a picture of what was done, along with a PDF attachment showing the systematic extent of this mindless exposure of confidential information (20 cases at a time). We have sought to responsibly redact these communications. We also think it important to document this egregious practice.
This is not the first time that Mediation.com has been caught red-handed inappropriately sharing confidential information. Please see this article about how this company directed communications intended for specific (non-paying) listed panel members to other (paying) listed panel members. This research was done by respected colleague Don Philbin.
Mediation.com has also made clear through numerous communications that they will be targeting Mediate.com Members “more than ever” (if that is possible), so please do be aware that their incessant phone calling will likely continue. Please especially note that MEDIATE.COM HAS NEVER MADE A “COLD” SALES PHONE CALL IN 20 YEARS OF BUSINESS! It is, quite simply, not they way we do business.
As a contrast, Mediate.com was recently identified as a Top 10 Attorney Directory by Attorney Rankings. In fact, Mediate.com has been identified as the #9 attorney directory overall! Mediation.com is not even listed in the top 100 attorney directories!
In sum, please be cautious about working with Mediation.com. From the beginning, they have engaged in deceptive practices, and it is clear from their systematic disclosure of confidential client information that they don’t have much of a clue about the expected confidentiality and integrity of mediation communications.
