Tips for Successful Mediation        

Be prepared to discuss all sides of the dispute - not just yours.     

Accept responsibility for being part of the problem - then become part of the solution.     

Be familiar with the facts and legal principles involved in the dispute.     

Don't be afraid of creative solutions.     

At the mediation, be polite and diplomatic. Harsh words produce harsh results.

Be as open and honest as you can with yourself and the mediator. This helps bring about a settlement.     

Be fully aware of the costs you will incur if the dispute proceeds to trial.     

Know these things before arriving at the mediation - BATNA and WATNA

BATNA = Best Alternative to Negotiated Agreement     

WATNA = Worst Alternative to Negotiated Agreement
