Fees and Costs

      Mediation is done on a time and cost basis. Mr. Smith charges $300.00 per hour with a $3,000 per day maximum. Additional costs include room rental and special aids as agreed. The fees and costs are allocated equally or as agreed to the parties. Preparation time is billed separately from the mediation itself, and except in unusuall cases, will be at a maximum of five hours regardless of time spent. Preparation includes the administrative setup and phone conferences before the mediation, and review and research on materials submitted in advance to the mediator. Any post mediation work is billed at an hourly rate of $300 per hour.

     Mr. Smith has a half day minimum, and defines a half day as 5 hours. This is based on his belief that most disputes are more complex than the parties think, and it takes about 5 hours to resolve most disputes. Mr. Smith is a participant on some court panels. Some panels require the mediator to contribute some pro bono time, For example, Contra Costa County where Mr. Smith does most of his mediations requires up to 30 minutes of preparation time and the first two hours of a mediation are pro bono. These credits are applied to the half day minimum. The balance is to be paid before mediation.
