Mediation Philosophy

     Mediation is the most effective process to resolve disputes. It is my practice to help the parties focus on the issues and the cost alternatives. My mediation technique is more evaluative than facilitative. Parties want their mediator to offer insight and to assist in making solutions. Parties want closure more than a trial.

     I have participated as a mediator in many disputes where it did not appear resolution was possible. But the process worked - and a settlement occurred. And I have never seen a party leave unhappy with a settlement in place. I spent over 30 years developing skills to help clients win in litigation. I now use these tools to help parties win by making a sensible mediated settlement. To improve my skills as a mediator, I have completed over 100 hours of specialized training, and have received certification as a mediator. I have served as a mediator or neutral in over 130 matters in the past 10 years. I have joined the Northern California Mediation Association and participate in their seminars and training literature. And I participate in the activities of Mediate.Com.      The average cost of a trial is a range from $30,000 to over $1,000,000. The average cost of a mediation is a range from $3,500 to $25,000. The best mediator is less costly than the cheapest trial. My belief is that a fair settlement is always better than a good trial.
