Mediation WorksMy educational background before I became an attorney was rooted in the humanities and expository writing. Job-wise, I worked for a lot of non-profit organizations including the Pacific Division of the Red Cross. I took a number of electives in law school including alternative dispute resolution and international law thinking that I could make a difference in the world. After graduation, I practiced civil litigation for several years. I enjoyed problem-solving and being an advocate/counselor. However, after seeing the limitations of resolving disputes in court, I thought I was missing the transactional side of law. If I could help the parties negotiate a comprehensive agreement and write a better contract, I thought a lot of disputes could be avoided and our society would be less litigious.
Over the years, having negotiated a variety of commercial contracts and numerous contract disputes, I have concluded that having disputes is not the problem; it is how we resolve them that is the crux of the matter. We as a society need a mechanism that is flexible and takes the parties’ legal and non-legal needs into account. I like the fact that mediation is forward-looking and can help preserve relationships, as opposed to litigated matters which focus on rectifying past wrongs and returning the parties to status quo ante without regard to the relationship aspect of things.
The mediation style I practice is “facilitative,” meaning I help the parties to come up with their own solutions--but I also add my own thoughts and suggestions (based on my life experiences and education/training). Whether they are inherited or learned traits, I am also multi-cultural, curious and pragmatic.
I have mediated a variety of cases including business disputes, collections, fraud, breach of contract, landlord/tenant, civil harassment, personal injury, premises liability, construction defect, general civil, and subrogation. It is my honor to serve on the Los Angeles and Orange County Superior Court civil mediation panels.
