My Mediation Philosophy
I believe that facilitative mediation is a quick, economical and appropriate method to solve most disputes, including hotly contested lawsuits. I strongly believe that nearly every dispute, no mater the complexity, intensity or amount in controversy, can be resolved on terms acceptable to all parties if, but only if, the parties are willing to open themselves to directly and fearlessly confronting themselves, their opponents, the law, the admissible evidence and the ambiguity and uncertainty of litigation. My normal approach to mediation is to allow each side to present its position directly to the other side, allow each side to challenge the other position and to persuade the parties to confront the realities of litigation, their weaknesses, their needs and their real motivations. It is my experience that the parties and their legal counsel know best what is important and what is acceptable. I firmly believe, based upon a lifetime of experience, that a fair settlement is almost always superior to a great lawsuit.Beyond ideas of right-doing and wrong-doing, there is a field.
