Business Disputes

Business disputes are common, disruptive and expensive.  Some disputes are with customers.  Some are with suppliers.  Some are with competitors.  Many are internal disputes involving partners, managers and problem employees.  Most of these disputes can, and should, be resolved by mediation, preferably without recourse to litigation.  But, even where a business finds itself in court, mediation is generally a highly effective tool to end the fighting. Mediation can:
  • Resolve a dispute promptly
  • Reduce the financial costs of the dispute
  • Reduce the emotional costs of the dispute
  • Provide confidentiality for the dispute and its outcome
  • Allow the parties to meet at a time convenient to them
  • Allow for flexibility and creativity in resolving the dispute
  • Allow the parties to take a collaborative problem solving approach
  • Avoid getting trapped in endless litigation
  • Allow the parties to “get on with business”
So, whether a dispute is internal or external and whether it is currently in litigation or not, mediation should be considered as the most desirable dispute resolution mechanism.  You may wish to suggest it to your attorney, if you have one.
