Articles:The Rojas case represents the dilemma that arises when two public policies collide. On the one hand is the established, strong public policy in the United States that requires the parties to disclose all relevant evidence. On the other hand is the newer but equally strong public policy supporting the confidentiality of conciliation so that the process can be as safe as possible. Transatlantic Dispute Resolution The recent expansion of the European Union is likely to lead to a further, dramatic increase of the number of transatlantic disputes. The only efficient way to deal with them is by mediation or a similar alternative dispute resolution method, followed by arbitration if the mediation fails to lead to a settlement. |
