Description of Practice
My law practice consists of business, commercial and probate litigation, and employment law and litigation, in approximately equal portions. I practice both before courts and before arbitrators and arbitration panels. I have been co-counsel in complex class actions. As an arbitrator, I have heard consumer, title insurance, employment discrimination (gender, age, race, disability,national origin), FMLA, breach of employment contract, breach of fiduciary duty, and medical malpractice cases, both as a single arbitrator and as a member of three arbitrator panels. As a mediator, I have mediated wage and hour, employment discrimination, breach of lease, and breach of construction contract cases. I have advised arbitration hearing panels as counsel for a local chapter of the National Association of Realtors.
Professional Background
I have practiced law in Kingsport, Tennessee since 1975. I have served as chairman of my firm since its inception, and served as managing shareholder of a predecessor firm. I am licensed to practice law in Tennessee, and have been admitted to practice before the United States District Court for the Eastern District of Tennessee and the United States Court of Appeals for the Sixth Circuit.

Listed as General Civil Mediator pursuant to Rule 31 of the Rules of the Tennessee since 2007. Listed as an approved mediator (2007) and arbitrator (2004)by the United States District Court for the Eastern District of Tennessee.

Approach
My approach is facilitative, and to a degree evaluative,with the parties' consent. I take the traditional approach of an intitial joint session followed by caucus sessions. I may confer separately with counsel.
Fees
$225.00 per hour, including time for review of pre-session materials. Travel time is billed at 2/3 the regular rate. There is no cancellation fee unless the mediation is cancelled within 48 hours of its scheduled start. The cancellation fee in that event is $450.00 I will bill mileage, airline fare, and reasonable lodging and meals, if applicable.
Other Information
My articles have been published several times in the Tennessee Bar Journal. I am a past president of the Kingsport Area Chamber of Commerce, of my Rotary Chapter, of my local bar association, and of the Kingsport Chamber Foundation.
