Collaborative Divorce
A relatively new idea to Pittsburgh, Collaborative Divorce is an innovative process that is sweeping the country. Its popularity arises from its concern and attention to the parties' overall well-being. The goal is to keep the entire matter out of court, yet provide for both parties' needs and interests by working out an amicable arrangement between the parties. This makes most sense when one realizes that practically all divorces are ultimately resolved (even if it's on the eve of trial or on the courthouse steps) by an agreement between the parties. Judges do not want to engage in lengthy trials or make personal, private decisions for people about their finances and family lives. Since it is their job to do so, courts will make these decisions, but only after costly and time-consuming litigation. If parties want to use the Collaborative Process, they still have all the advantages of a litigated divorce, lawyers engaging in negotiations for them, but none of the courtroom confrontations or costs. At the heart of the Collaborative process is respect for each party's needs, dignity, integrity, and preservation of important family relationships. The attorneys sign a pact at the beginning of the case pledging not to litigate in court, not even in motions court, and not even on a minor matter. If an attorney sees court as the only option, the attorney must withdraw from the case. The clients are protected in this process as each attorney must advocate for the client's best interests. Clients take part in most negotiations in four-way meetings so that most of the process takes place out in the open, not behind closed doors where attorneys and judges often do the work in the traditional courtroom process. Lynn MacBeth is trained in the Collaborative Process and is currently taking on Collaborative Divorce and Custody cases.
