The Federal Sector (U.S.) continues to provide momentum
for the institutionalization of workplace ADR. Both the draft
Bill requiring mediation by contract mediators and the
Core Principles for ADR programs are worthy of attention.
The Mediation Information and Resource Center has
permission to publish articles written for the Conflict
Resolution Center in Cape Town, South Africa.
Laurie Nathan's article is the first.

At The Core: Six Strategic Principles

There are many striking differences between the approach
to mediation adopted by the Centre for Conflict Resolution
in South Africa(CCR) and that pursued by the United Nations
(UN), the Organisation of African Unity (OAU) and major
powers. In this article Laurie Nathan, the executive director
of CCR, highlights some of the key differences by outlining
six strategic principles which underpin their mediation efforts
but which frequently are not applied by international actors.

When Should Race, Gender Or Culture Be A Factor When Considering The
Mediator?

obvious answer. It is the one that all mediators would agree upon.
Namely, "When the parties want and believe that the consideration
of the race, gender or culture of the mediator would help resolve
their dispute."

3.1 New bill to require EEOC mediation.
National Employment Dispute Resolution Act of 2000 (NEDRA)
To amend title VII of the Civil Rights Act of 1964, the Age
Discrimination in Employment Act of 1967, the Americans with
Disabilities Act of 1990, the Vocational Rehabilitation Act
of 1973, and the Civil Rights Act of 1991, to require the Equal
Employment Opportunity Commission to mediate employee
claims arising under such Acts.

3.2 Core Principles for Non-Binding Workplace ADR Programs
and Developing Guidance for Binding Arbitration-
A Handbook for Federal Agencies
These two documents, released on August 16, 2000 will assist
Federal agencies in developing workplace ADR programs.
They were created by the Federal ADR Council, a group of
high level government agency officials chaired by the
Attorney General. The documents are based on the
combined expertise of ADR specialists in federal agencies
with active ADR programs. The first document describes
ten key elements that are essential in any fair and effective
ADR program. The second document provides information
and assistance for agencies on the use of binding arbitration.

4. News from Southern Africa
Biehls Launch Aids Awareness Campaign
On the seventh anniversary of their daughter Amy's death,
Peter Biehl visited the place where she was murdered to
hand out bread to local residents, promote Aids awareness
and embrace one of the four men convicted of her killing.
Ntombeko Peni and Easy Nofomela, two members of a
mob that stabbed and stoned Biehl to death in 1993 in
Guguletu township outside Cape Town, now work for the
Amy Biehl Foundation. They were granted amnesty for the
killing by the Truth and Reconciliation Commission.
The Biehls' latest project to promote HIV and Aids
awareness in SA is to print information about the
disease on bread wrappers that bear Amy's name
and which comes from a bakery set up by the foundation.
