I agree, preparation is the key to a successful mediation. Counsel and parties must understand the realistic settlement value of the case based upon the facts, the law, and the unique values and needs of the principles. In my experience, when the parties are prepared the case almost always settled.

I find that too much preparation leads to more committed entrenchment in positions and functionally blocks the promise of creativity and the potential for resolution. The more energy you devote to one outlook through preparation becomes an investment in that outlook such that resistance to possibilities increases...
