Rojas v. Superior Court: The Battle of Two Opposing Public Policies

ABSTRACT: The Rojas case represents the dilemma that arises when two public policies collide. On the one hand is the established, strong public policy in the United States that requires the parties to disclose all relevant evidence. On the other hand is the newer but equally strong public policy supporting the confidentiality of conciliation so that the process can be as safe as possible.
