Drawing upon various social science research findings, Melissa Nelken will illustrate and discuss the following cognitive traps and lead a discussion about how to apply the implications of these findings to the work of a mediator.
· Risk aversion: Do people prefer smaller sure payoffs or uncertain larger payoffs? Under what conditions?
· Reactive devaluation: Why are the agent and the timing of an offer so important to its acceptance?
· Status quo bias: What makes change so difficult?
· And others ...
Melissa Nelken is Professor of Law at UC Hastings College of the Law and Faculty Chair of the Hastings Center for Negotiation and Dispute Resolution. She has taught Negotiation and Mediation at Hastings since 1980 and is the author of Understanding Negotiation (Anderson Publishing 2001). She has a BA from Brandeis University, an MA from Harvard University, a JD from the University of Michigan, and is a graduate and faculty member of the San Francisco Psychoanalytic Institute. In addition to her teaching, she is in private practice as a psychoanalyst, working with individuals and couples.
Cost:
Early registration (up to one week before the program):
