Using BATNA & WATNA
in Conflict Resolution

You’ve heard about it. Do you use it? Do you wish you did?

Friday, August 27, 2004, 12:30 – 4:00 p.m.

(Registration at 12:00. Bring your lunch and network before the program.)

Room 535, Golden Gate University

536 Mission Street, San Francisco  (near Montgomery BART station)

Many mediators learn about the concept of “BATNA and WATNA” (Best and Worst Alternatives to a Negotiated Agreement) in basic mediation training, but few have a clear method for applying it. This workshop will teach a useful approach and will provide opportunities to practice it in exercises that explore a variety of different contexts, with factors that can alter the meaning or approach of the analysis.

Mediators who learn to apply this analysis effectively do a great service to their clients, enabling them to make better informed decisions about possible settlements in mediation.

Jessica Notini, J.D., attorney since 1989 and mediator since 1994, has an extensive international practice as a mediator, teacher, and trainer. Her practice encompasses a variety of areas, including probate and estate, business, employment, and landlord-tenant disputes. She is an Adjunct Professor of Mediation at Golden Gate University, and has developed and led courses and trainings for many organizations, domestic and foreign—among them: Square Trade, the eBay online mediation service; Habitat for Humanity; Stanford, Boalt, and Hastings Schools of Law; and organizations in Mexico, Spain, Peru, and Ecuador. She currently serves as the Education Co-Chair for the Mediation Society and has served three terms as President of the Association for Dispute Resolution, Northern California. She maintains a sense of humor.
