The Association for Dispute Resolution of Northern California (ADRNC) and the Bar Association of San Francisco are pleased to welcome renowned mediator, attorney, and author, J. Anderson Little. His recent book, Making Money Talk, is the quintessential guide to the art and practice of mediating disputes where it really is all about the money.

 

Morning Mediator Session: 9:00 a.m. – 12:00 noon

Learn how to employ the principles of “control theory” to deal with the many recurring problems of insured claims and money disputes, including:

  • The problem of, “Who goes first?”
  • “I’m not going to bid against myself!”
  • “Go tell them to give me a realistic number.”
  • “Is that his best number?”
  • “I’m not going to dignify that offer with a response.”

 

You will also learn techniques that will help you:

  • Gain a better understanding of the dynamics of money negotiations.
  • Identify the recurring problems presented in those cases.
  • Acquaint and arm yourself with new tools to handle those challenges.
  • Build a model of the mediation process that will serve as a roadmap when traditional bargaining is unavoidable.
  • Assist the parties in traditional bargaining in a facilitative, rather than a directive way.

Afternoon Negotiator Session: 2:00 p.m. – 5:00 p.m.

This is a practical skills seminar about negotiations in the context of civil trial court mediation. We will concentrate on the negligence claims that dominate civil litigation in state courts. Negotiations in these cases are characterized by bargaining about money and rarely lend themselves to the problem solving approach that the literature of mediation and negotiations advocate. The afternoon session will cover:

  • The mindset of the negotiator (as opposed to the trial advocate).
  • Developing the information needed to make informed decisions.
  • Helping clients become grounded in the realities of their case (case analysis).
  • Formulating a plan of movement during negotiations.
  • Where do I start?
  • What is my walk away number?
  • How will I move from one to the other?
  • The Top Ten Things Great Negotiators Do to maximize their settlements and not leave money on the table.

Presenter: Andy Little is trained and certified as a Civil Trial Court and Family Mediator. With a flourishing full-time practice and over 15 years of experience in mediation, Andy has mediated in excess of 4,000 cases.

Prior to setting up his mediation practice, Andy has 17 years experience as a trial lawyer in commercial, personal injury, domestic, and criminal cases. Andy’s practice is now devoted exclusively to conducting mediated settlement conferences and teaching others mediation skills and techniques.

Andy Little chaired the committees that created the mediation programs in North Carolina. He was the first Chair of the North Carolina Bar Association’s Dispute Resolution Section, served two terms on the Dispute Resolution Commission, and served as the Commission’s Chair by appointment of the Chief Justice. He is the author of Making Money Talk: How to Mediate Insured Claims and Other Monetary Disputes, published by the American Bar Association.
