Mediators inevitably bring their own biases and assumptions to the table when working with parties. Once we start to recognize and explore our own biases, the question becomes how to deal with it. How can we behave with the same tolerance and open-mindedness that we seek from parties in conflict? How can we create the presence of mind to respond positively and productively to party disrespect, insults and escalation? How can we maintain our integrity by “walking the walk, not merely talking the talk”? This workshop on Mediating with Mindfulness will address these questions. 

 

Workshop Agenda

  • Identifying the Dilemma (fishbowl demonstration)
  • Mindfulness as a Solution (short presentation)
  • The Tools of Mindfulness (short presentation)
  • Practicing Mindfulness (experiential exercises and discussion)
  •  Physical, Mental, and Emotional Awareness
  • Application to Mediation (discussion, role play)

 

Workshop Leader

Darshan Brach, JD, is an EBCM Training Committee volunteer and experienced teacher and supervisor of mediation. In the Boston area she has worked with a community mediation program, the Harvard Mediation Program, the University of Massachusetts Graduate Program on Dispute Resolution, and the state office of dispute resolution. In California she has taught Mediation at Santa Clara School of Law and Negotiation at UC Hastings.
