Mediation Case Scenarios |
Overview Following is a collection of mediation case scenarios designed to assist with ethics instruction. Each has a heading to help the trainer find the scenario which best matches the specific needs of their training module: the type of ethical issue, the type of case and the length of the scenario.
The categories of ethics issues are adapted from Robert Baruch Bush’s types of ethical dilemmas:
- Confidentiality
- Impartiality
- Avoiding Conflict of Interest
- Self-Determination
- Informed Decision Making
- Fairness of the Process
- Role of the Mediator
- Avoiding Harm
- Mediator Competency
Discussion Questions The case scenarios can be used in a number of ways. Following is a list of sample questions that can be used to process the scenarios. Obviously, all questions may not be appropriate for all scenarios.
- Is there an individual or an issue in this scenario that could raise any potential issues of bias for you? What do you believe to be the origins of this bias? What could you do to address the problem?
- What is the ethical issue raised in this scenario?
- What sections of the (name of the ethics code) relate to this ethical dilemma? What specific guidance does it offer?
- Compare what these (two or three) codes of ethics say that relates to this ethical dilemma. What are the similarities? Where are there contradictions?
- Are there potential legal issues raised in this scenario? If so, what are the specific laws that are relevant?
- Does the mediator’s behavior in this scenario constitute an ethical violation? Why or why not?
- What could the mediator have done to avoid being confronted with this ethical dilemma?
- What should the mediator do to address this situation?
- In your small group, say exactly what you believe the mediator should say to address this situation.
