Randal Mashburn

Randal Mashburn has mediated numerous commercial, financial and business disputes. Examples of recent mediations include disputes involving executive compensation, wrongful termination, tortuous interference with contractual relations, breach of commercial leases, lender liability, fraud involving health benefit plans, minority shareholder rights, misappropriation of funds by management, partnership dissolutions, breach of option to purchase a medical facility, lien priorities, fraudulent transfers and various bankruptcy-related litigation. All were successfully settled as a result of mediation. 

Randal has more than 100 hours of training in mediation and arbitration, is a Supreme Court Rule 31 Listed Mediator, and is on the ADR Panel for the U.S.  District Court for the Middle District of Tennessee. He is a certified arbitrator for Better Business Bureau claims and serves as a volunteer mediator for and a board member of the non-profit Nashville Conflict Resolution Center.  

Randal is a shareholder with Baker, Donelson Bearman, Caldwell & Berkowitz in its Nashville office.  He has more than 25 years experience involving a wide variety of litigation over contracts, bankruptcy, insolvency, lender liability, fraud, director/officer liability, banking, business dissolutions, UCC issues, real estate and other types of commercial and financial matters.  He has been listed for more than ten years as one of The Best Lawyers in America and in Chambers USA Ranking Guide of America’s Leading Business Lawyers. He is certified as a business bankruptcy specialist by the American Board of Certification. 

He is a past-president of the Mid-South Commercial Law Institute and serves on the Board of Directors of the Tennessee Association of Professional Mediators.  He has spoken frequently on alternative dispute resolution, bankruptcy and creditors’ rights before bar associations, industry organizations and other groups. 

Randal graduated from the University of Memphis School of Law and received his undergraduate degree from the University of Tennessee.  He served as a law clerk for Judge Odell Horton on the United States District Court for the Western District of Tennessee and Judge Lew Conner on the Tennessee Court of Appeals.  

He has been married to his wife, Janice, for 28 years.  In his spare time, Randal enjoys collecting and tinkering with antique clocks -- a hobby that serves as a constant reminder of the importance of patience and persistence, qualities which are obviously also useful in his mediation practice.
