Do I need an Attorney?
There is no legal requirement that one be represented by counsel in order to participate in a mediation.  However, the resolution of a construction dispute can be confusing and complex.  Often, such disputes involve valuable legal rights where considerable sums of money are at risk.  In such cases, it is always good practice to consult with an attorney and to seek guidance from experienced legal counsel throughout the mediation process.

Generally attorneys are helpful to a facilitated negotiation.  The lawyer can help his client weigh his options and evaluate the substance and risk of positions taken during negotiations.  Further, the attorneys play a vital role in documenting any agreement after a deal has been done.
