Pre-Mediation Steps

 

I will normally arrange a 10 minute pre-mediation telephone conference for legal advisers and I have a Telecom pin number that makes this a fairly straightforward exercise.

On that call we will cover:

1.      the mediation agreement – is it acceptable in its present form or does it require changes?

2.      what documents need to be provided to me as mediator and to be available at the mediation – usually the pleadings if proceedings have been issued and important documentation such as any base contract, milestone correspondence etc   

3.      where the mediation is to take place – counsel may have adequate facilities or, if a neutral venue is required, I can arrange a board room and breakout rooms

4.      the date and commencement time of the mediation

5.     who will attend on the day
