Mediated Case Management

When litigation is inevitable, I have worked with the parties involved as a third-party neutral case manager to resolve as many procedural and legal disputes as possible, helping streamline and accelerate the litigation process.
The role of the third-party neutral is particularly effective in large cases involving many parties, where the procedural aspect of litigation (eg discovery of documents) can often take on a life of its own, overshadowing substantive issues.
Mediated Case Management has the potential to avoid the need for many of the normal interlocutory applications large multi party cases usually attract thus realising extraordinary savings on litigation costs.
The cost of the third-party neutral is usually split between the parties.

Facilitated Mediation-Negotiation Rehearsal
For high value mediations and negotiations, rehearsing with one team role playing the opposing side can reveal unforeseen dynamics and allow better strategies to be developed.
