Mediation of employment matters - pre-complaint or later - has significant advantages. It permits management to avoid the risk, distraction, lost executive time, distress and expense of divisive litigation. It also permits current or former employees to obtain contemporary legal remedies much sooner without the delay, uncertainty, anxiety and risks of litigation. Mediated resolution can also protect an individual's future employability in ways impossible to obtain in court. Such resolution can also lead to manager and supervisor training, preventative legal advice and documentation which prevent future litigation and increase profits.
Description of Practice
A practicing employment attorney for 32 years, Dave Smullin is a full-time mediator specializing in employment cases. These include sexual harassment, wrongful termination and various forms of discrimination such as age, sex, compensation, race, handicap, reprisal, religion, union, national origin, appearance, protected concerted activity, NLRA, and Title VII, among others.
Professional Background
Mr. Smullin has had decades of experience, representing individual employees as real parties in interest and employers as clients in private practice. He began his career working as a Trial Specialist in the San Francisco Regional Office of the National Labor Relations Board for 9 years. He was in trial in over 50 cases, winning more than 90% of them. He also worked daily with individuals, employers and labor organizations in resolving heated harassment and discharge issues as well as similarly emotional election cases. Smullin was then hired by a respected Silicon Valley law firm to create an employment law practice for that firm. After 5 years, while A-V rated, he founded an employment law firm. Thereafter, he continued to practice in Silicon Valley for 17 years.
While with the NLRB, Smullin was an active member of the Bar Association of San Francisco Labor and Employment Law Section. In 1978, he joined the Santa Clara County Labor and Employment Law Section. Except for his sabbatical, he has continuously been an active member of its Executive Committee for 34 years, chairing it in 1980 and 1981.
Degrees:
Smullin earned a B.A. With Distinction at Stanford University in 1965. He received his Juris Doctor degree from the University of California School of Law (Boalt Hall) in 1968. During his sabbatical in 1988-89, Smullin studied finance under Ian Tonks at the London School of Economics.
Fees
$400 per hour of mediation.
No administrative or set-up fee.
No charge for pre-mediation telephone conferences regularly conducted prior to a mediation.
