The Healthcare Section seeks to provide leadership in conceptualizing and educating the public and health care industry about the uses of dispute resolution in health care (inclusive of mental health). It is also committed to spreading the Association for Conflict Resolution principles of effective conflict prevention and management, and to providing opportunities for persons from diverse communities to enter and succeed in the dispute resolution field through education and training, mentoring, and other forms of collegial relationships.

The Section identifies best practices and shared knowledge and experiences to help ACR Healthcare Section members excel in providing dispute resolution services to individuals and organizations dealing with health care issues.

          A Plaintiff’s Lawyer’s Perspective on Malpractice Mediation

In our November teleseminar we heard from a hospital risk manager who talked about how he typically looks at mediation as an option in medical malpractice cases.  Do lawyers representing the other side see mediation differently?  In this teleseminar, John Kennedy, a trial lawyer who represents plaintiffs in malpractice cases, will share his views on mediation:  what cases it’s appropriate for, and at what stage; what its advantages and disadvantages are for the plaintiff side; and what he looks for in a mediator. 

John Kennedy, a founding partner in the firm of Kennedy, Johnson, D'Elia, & Gillooly, has practiced law in New Haven for 32 years, representing thousands of clients and trying numerous civil cases in the Connecticut state and federal courts. His practice includes representation of injured persons in automobile accidents, premises liability, medical malpractice, and product liability cases, as well as other civil disputes.

He is a member of the New Haven County Bar Association and served as president of that organization in 1991 and 1992.  He also participates in the American Association for Justice and the Connecticut Trial Lawyers Association of which he has been a member of the Board of Governors since 1990 and is currently President Elect.  In addition, Mr. Kennedy is a member of the American Board of Trial Advocates and a fellow of the American College of Trial Lawyers.
